Please read these Terms of Use (“Terms”) carefully as they govern your use of (which includes access to) One Deaf World’s personalized services for streaming music and other content, including all of our websites and software applications that incorporate or link to these Terms (collectively, the “One Deaf World Service”) and any music, videos, podcasts, audiobooks, or other material that is made available through the One Deaf World Service (“Content”).
Use of the One Deaf World Service is subject to the One Deaf World Privacy Policy and additional terms and conditions presented by One Deaf World, all of which are made part of these Terms by this reference.
By signing up for, or otherwise using, the One Deaf World Service, you agree to these Terms. If you do not agree to these Terms, then you must not use the One Deaf World Service or access any Content.
THESE TERMS CONTAIN A MANDATORY ARBITRATION PROVISION THAT, AS FURTHER SET FORTH IN SECTION 6 BELOW, REQUIRES THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR ANY OTHER COURT PROCEEDINGS, OR CLASS ACTIONS OF ANY KIND. IN ARBITRATION THERE IS LESS DISCOVERY AND APPELLATE REVIEW THAN IN COURT.
Service provider
These Terms are between you and One Deaf World Inc., Age and eligibility requirements
BY USING THE ONE DEAF WORLD SERVICE, YOU AFFIRM THAT YOU ARE 18 YEARS OR OLDER TO ENTER INTO THESE TERMS, OR, IF YOU ARE NOT, THAT YOU ARE 13 YEARS OR OLDER AND HAVE OBTAINED PARENTAL OR GUARDIAN CONSENT TO ENTER INTO THESE TERMS. Additionally, in order to use the One Deaf World Service and access any Content, you represent that: you are abiding by your country and state laws, and any registration and account information that you submit to One Deaf World is true, accurate, and complete, and you agree to keep it that way at all times.
One Deaf World Service options
We provide numerous One Deaf World Service options. Certain One Deaf World Service options are provided free of charge, while other options require payment before they can be accessed (“Paid Subscriptions”). We may also offer special promotional plans, memberships, or services, including offerings of third-party products and services. We are not responsible for the products and services provided by such third parties.
Trials
From time to time, we or others on our behalf may offer trials of Paid Subscriptions for a specified period without payment or at a reduced rate (“Trial”). By using a One Deaf World Service via a Trial, you agree to the One Deaf World Premium Promotional Offer Terms.
Third-party applications, devices, and open source software
The One Deaf World Service may be integrated with, or may otherwise interact with, third-party applications, websites, and services (“Third-Party Applications”) and third-party personal computers, mobile handsets, tablets, wearable devices, speakers, and other devices (“Devices”). Your use of such Third-Party Applications and Devices may be subject to additional terms, conditions, and policies provided to you by the applicable third party. One Deaf World does not guarantee that Third-Party Applications and Devices will be compatible with the One Deaf World Service.
Service limitations and modifications
We use reasonable efforts to keep the One Deaf World Service operational and to provide you with a personalized, immersive audio experience. However, One Deaf World reserves the right to change our One Deaf World Service offerings and their availability from time to time, without notice or liability to you. For example:
The One Deaf World Service may experience temporary interruptions due to technical difficulties, maintenance or testing, or updates, including those required to reflect changes in relevant laws and regulatory requirements.
We aim to evolve and improve the One Deaf World Service constantly, and we may modify, suspend, or stop (permanently or temporarily) providing all or part of the One Deaf World Service (including particular functions, features, subscription plans, and promotional offerings).
One Deaf World has no obligation to provide any specific content through the One Deaf World Service, and One Deaf World or the applicable owners may remove particular songs, videos, podcasts, and other Content without notice.
If you have prepaid fees directly to One Deaf World for a Paid Subscription that One Deaf World permanently discontinues prior to the end of your Prepaid Period (as that term is defined in the “Payments and cancellations” section below), One Deaf World will refund you the prorated portion of the prepaid fees for the Pre-Paid Period after such discontinuation. Your account and billing information must be up to date in order for us to refund you.
One Deaf World has no liability to you, nor any obligation to provide a refund to you, in connection with internet or other One Deaf World Service outages or failures that are caused by the actions of government authorities, other third parties, or events beyond our control.
User accounts
To use certain features of the One Deaf World Service, you may need to register for an account and provide certain information about yourself. You agree that the information you provide to One Deaf World upon registration and at all other times will be true, accurate, current, and complete. You also agree that you will ensure that this information is kept accurate and up to date at all times.
You are responsible for maintaining the confidentiality of your account credentials, including your username and password. You agree not to share your account credentials with any third party or allow any third party to access your account. You are solely responsible for all activities that occur under your account, whether or not authorized by you. One Deaf World is not responsible for any unauthorized access to your account.
User-generated content
The One Deaf World Service may allow you to submit, post, display, or otherwise make available content, including playlists, comments, and other materials (“User-Generated Content”). You retain ownership of any intellectual property rights that you hold in such User-Generated Content. However, by submitting, posting, displaying, or otherwise making available User-Generated Content on or through the One Deaf World Service, you grant One Deaf World a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User-Generated Content in connection with the One Deaf World Service and One Deaf World’s business, including without limitation for promoting and redistributing part or all of the One Deaf World Service (and derivative works thereof) in any media formats and through any media channels.
You represent and warrant that you have all the rights necessary to grant the license set forth above, that the User-Generated Content does not violate any laws or regulations or infringe or misappropriate any third-party rights, and that the User-Generated Content complies with these Terms.
Prohibited conduct
When using the One Deaf World Service, you agree not to:
Violate any applicable law or regulation Engage in any activity that is harmful, fraudulent, deceptive, or threatening.
Upload, post, transmit, or otherwise make available any content that is unlawful, harmful, abusive, offensive, defamatory, obscene, or otherwise objectionable.
Infringe upon the intellectual property rights or other proprietary rights of others.
Use the One Deaf World Service to transmit any viruses, malware, or other malicious code.
Interfere with or disrupt the integrity or performance of the One Deaf World Service or the data contained therein.
Attempt to gain unauthorized access to the One Deaf World Service, user accounts, or computer systems or networks connected to the One Deaf World Service.
Engage in any form of data mining, scraping, or similar data extraction methods.
Use the One Deaf World Service for any commercial or promotional purposes without obtaining prior written consent from One Deaf World.
One Deaf World reserves the right to investigate and take appropriate legal action against any user who violates these Terms or engages in prohibited conduct. One Deaf World may suspend or terminate your access to the One Deaf World Service if you violate these Terms or engage in any prohibited conduct.
Content availability
One Deaf World aims to provide a wide range of music and other content through the One Deaf World Service. However, One Deaf World does not guarantee the availability of any specific content. One Deaf World or the applicable content owners may remove or modify content without notice.
Intellectual property rights
The One Deaf World Service and all content available through the One Deaf World Service are protected by copyright and other intellectual property laws. You acknowledge and agree that all intellectual property rights in the One Deaf World Service and its content belong to One Deaf World or its licensors.
You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the One Deaf World Service and its content solely for your personal, non-commercial use in accordance with these Terms.
You agree not to reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the content available through the One Deaf World Service, except as expressly permitted by these Terms or with the prior written consent of One Deaf World or the applicable rights holder.
If you believe that your intellectual property rights have been infringed upon by any content available through the One Deaf World Service, please contact us in accordance with the procedures set forth in the “Customer Support, Information, Questions, and Complaints” section below.
One Deaf World provides customer support to address your inquiries, complaints, or requests for information regarding the One Deaf World Service. You can contact our customer support team through the channels specified on our website or within the One Deaf World Service.
We strive to address your concerns and provide timely assistance. However, please note that the resolution of certain issues may take time and be subject to limitations beyond our control.
Creating a One Deaf World account
To fully utilize the One Deaf World Service, you may need to create a One Deaf World account. Your chosen username and password are for your personal use only and should be kept confidential. You understand that you are solely responsible for all activities (including any unauthorized use) associated with your username and password. If you suspect any unauthorized access or believe your username or password has been lost or stolen, please promptly notify our Customer Support team.
One Deaf World reserves the right to reclaim or require you to change your username for any reason.
Your rights to use the One Deaf World Service
Access to the One Deaf World Service
Subject to your compliance with these Terms (including any other applicable terms and conditions), we grant you a limited, non-exclusive, revocable permission to access and use the One Deaf World Service and its content (“Access”) for personal, non-commercial purposes. This Access will remain valid unless terminated by you or One Deaf World. You agree not to redistribute or transfer the One Deaf World Service or its content.
The software applications and content provided by One Deaf World are licensed, not sold or transferred to you. One Deaf World and its licensors retain ownership of all copies of the software applications and content, even after installation on your devices.
One Deaf World’s proprietary rights
The One Deaf World Service and its content are the property of One Deaf World or its licensors. All One Deaf World trademarks, service marks, trade names, logos, domain names, and other distinctive features of the One Deaf World brand (“One Deaf World Brand Features”) are the sole property of One Deaf World or its licensors.
These Terms do not grant you any rights to use the One Deaf World Brand Features for commercial or non-commercial purposes.
User Content
The content you post on the One Deaf World Service
One Deaf World users may post, upload, or contribute content to the One Deaf World Service (“User Content”). User Content refers to all information, materials, and other content added, created, uploaded, submitted, distributed, or posted to the One Deaf World Service by users, including contributions made to the One Deaf World Support Community.
You are solely responsible for all User Content that you post.
By posting User Content on the One Deaf World Service, you warrant that: (1) you own or have the necessary rights to post such User Content, and (2) such User Content, or its use by One Deaf World in accordance with the granted license below, does not: (i) violate these Terms, including the One Deaf World User Guidelines, applicable laws, or the intellectual property or other rights of any third party, or (ii) imply any affiliation or endorsement of you or your User Content by One Deaf World, or any artist, band, label, or other individual or entity, without the prior express written consent from One Deaf World or the relevant individual or entity.
When posting or sharing User Content or other information on the One Deaf World Service, please be aware that it may be publicly accessible and may be used and re-shared by others on the One Deaf World Service and across the web. Therefore, exercise caution and be mindful of your account settings when posting or sharing on the One Deaf World Service. One Deaf World is not responsible for the content posted or shared by you or others on the One Deaf World Service.
Monitoring user content
One Deaf World may, at its discretion, monitor or review User Content, but is under no obligation to do so. One Deaf World reserves the right to remove or disable access to any User Content for any reason, without prior notification to you.
Licenses that you grant to us
User Content
When you post User Content to the One Deaf World Service, you retain ownership of your User Content. However, in order for us to make your User Content available on the One Deaf World Service, we require a limited license from you. By posting User Content, you hereby grant One Deaf World a non-exclusive, transferable, sublicensable, royalty-free, fully paid, irrevocable, worldwide license to reproduce, make available, perform and display, translate, modify, create derivative works from, distribute, and otherwise use such User Content through any medium, alone or in combination with other content or materials, in any manner and by any means, method, or technology, whether now known or hereafter created, in connection with the One Deaf World Service. To the extent permitted under applicable law, you also agree to waive any “moral rights” or equivalent rights, including the right to be identified as the author of any User Content, including Feedback, and the right to object to the derogatory treatment of such User Content.
Feedback
If you provide ideas, suggestions, or other feedback regarding the One Deaf World Service or any content (“Feedback”), such Feedback is non-confidential and may be used by One Deaf World without any restrictions or payment to you. Feedback is considered a type of User Content under these Terms.
Your Device
You grant One Deaf World the right: (1) to utilize the processor, bandwidth, and storage hardware on your Device to facilitate the operation of the One Deaf World Service, (2) to provide advertising and other information to you, and (3) to allow our business partners to do the same.
Content experience
The selection and placement of Content you access on the One Deaf World Service may be influenced by commercial considerations, including One Deaf World’s agreements with third parties.
Certain Content provided by or available on the One Deaf World Service, such as podcasts or shows, may incorporate advertising or other promotional messages.
Infringement claims
One Deaf World respects the rights of intellectual property owners. If you believe that any Content infringes your copyright rights, please refer to the One Deaf World Copyright Policy for further information on how to address such claims.
You agree to comply with the One Deaf World User Guidelines and use the One Deaf World Service and its content only as expressly permitted by these Terms.
Payments and cancellation
Billing
To access certain features of the One Deaf World Service, you may be required to purchase a subscription directly from One Deaf World or through a third party. This can be done by:
Tax rates will be calculated based on the information you provide and the applicable rates at the time of your monthly charge.
If you purchase a subscription through a third party, additional terms and conditions may apply, and you should refer to the respective third party for refund or subscription management inquiries. If you purchase a subscription using a code, gift card, prepaid offer, or any other offer provided by or on behalf of One Deaf World, you agree to abide by the One Deaf World Card Terms.
Price and tax changes
One Deaf World may periodically modify the pricing for subscriptions, including recurring fees, Prepaid Periods (for periods not yet paid), or other offers. Any price changes will be communicated to you in advance. By continuing to use the One Deaf World Service after the price change takes effect, you accept the new price. If you do not agree with a price change, you can reject it by canceling your subscription before the change becomes effective.
Tax rates may vary over time due to local tax requirements in your country, state, territory, county, or city. Any changes in tax rates will be automatically applied based on the information you provide in your account.
Renewal and cancellation
Unless you have a prepaid subscription for a specific period, your payment for a One Deaf World subscription will automatically renew at the end of each subscription period, unless you cancel your subscription before the current period ends. To cancel your subscription, please follow the instructions provided by our Customer Support team. The cancellation will take effect on the day after the last day of the current subscription period, and your access to the subscription features will be downgraded to the free version of the One Deaf World Service. Please note that we do not offer refunds or credits for partially unused subscription periods, except as expressly stated in these Terms.
If you have purchased a subscription using a code, your subscription will automatically terminate at the end of the period specified by the code or when the prepaid balance is insufficient to cover the cost of the One Deaf World Service.

By using the One Deaf World Service and subscribing to our services, you acknowledge and agree to the above billing, payment, and cancellation terms.
These Terms of Use will remain in effect until either you or One Deaf World terminates them. You have the right to terminate these Terms of Use at any time by closing your One Deaf World account and discontinuing your use of the One Deaf World Service. One Deaf World also reserves the right to terminate these Terms of Use or suspend your access to the One Deaf World Service at any time, for any reason, including but not limited to violations of these Terms of Use or engaging in fraudulent, harmful, or illegal activities.
Upon termination of these Terms of Use, your right to use the One Deaf World Service will cease, and you must immediately cease all use of the Service and delete any downloaded or saved content associated with the One Deaf World Service.
Arbitration
Any disputes arising out of or relating to these Terms or your use of the One Deaf World Service shall be resolved through binding arbitration on an individual basis. The arbitration will be conducted by a neutral arbitrator in accordance with the rules of the arbitration organization chosen by One Deaf World.
Governing Law
These Terms and your use of the One Deaf World Service shall be governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of laws principles.
These Terms constitute the entire agreement between you and One Deaf World regarding your use of the One Deaf World Service and supersede and prior agreements or understandings, whether written or oral.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
One Deaf World’s failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
You may not assign or transfer these Terms, in whole or in part, without the prior written consent of One Deaf World. One Deaf World may freely assign or transfer these Terms without restriction.
These Terms are not intended to create any agency, partnership, joint venture, employment, or franchise relationship between you and One Deaf World.
Any notices or communications provided by One Deaf World to you under these Terms may be sent to the email address associated with your account or through other means of communication available within the One Deaf World Service.

Registration
In order to work with us, a user may first complete the registration form. During registration a user is required to give certain information (such as name and email address). We request information from you on our request for services forms. We take precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline.
Wherever we collect sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure way. You can verify this by looking for a closed lock icon at the bottom of your web browser, or looking for “https” at the beginning of the address of the web page. If a credit card form is submitted via email, we protect that information by allowing limited password-protected access to the form.

Surveys & Contests
Our site may requests information via online forms. Filling out these forms is completely voluntary and you may choose whether or not to participate and therefore disclose this information. This is used solely to determine your ability to work with us as a subcontractor and to notify you of open assignments in your area.
